Alcohol is a legal drug. But it can lead to significant harm when misused so there are a number of laws governing its sale, purchase and consumption.
The Licensing (Scotland) Act 2005 comes into force on 1 September 2009. It is founded on 5 objectives:
- preventing crime and disorder
- securing public safety
- preventing public nuisance
- protecting and improving public health
- protecting children from harm
Scotland's licensing system is adminstered by Licensing Boards, overseen by Local Licensing Forums, monitored by Licensing Standards Officers, and enforced by police.
There is a dual licensing system of premises and personal licences. All outlets where alcohol is served and sold require a premises licence. A personal licence is issued to an individual and allows them to authorise the sale of alcohol. To be eligible for a personal licence, the applicant must be over 18 and hold a licensing qualification accredited by the Scottish Qualifications Authority, such as ServeWise.
